The Proposed Intervenor is the holder of a promissory noteencumbering the property underlying this action. A. FACTS This matter was commenced by way of writ, summons, and complaint dated November 6,2023, and bearing a Return Date on January 16, 2024. The complaint alleges the defendant,Shyanne Valentine (the “Defendant”), is the owner of the certain real property known as 684-686Kossuth Street, Bridgeport, Connecticut (the “Property”). The complaint further alleges that theDefendant has failed, refused, neglected, and declined to pay the bill due and owing to theplaintiff, Water Pollution Control Authority (the “Plaintiff”. The Plaintiff fails to include the Proposed Intervenor in this matter despite its interest inthe Property. On or about July 5, 2022, the Defendant executed and delivered a Note (the“Note”) for a loan in the original principal amount of $368,207.00 to Total Mortgage Services,LLC. On or about that same date, the Defendant did execute an Open-End Mortgage Deed (the“Mortgage”) conveying her interest in the Property to Total Mortgage Services, LLC. The {02 coOT Mortgage was recorded on July 12, 2022, in Book 10821 at Page 64 of the Bridgeport Land Records. The Note was transferred to the Proposed Intervenor effective October 1, 2022, who has remained the authorized loan servicing agent for, and in possession of, the same at all times since. A true and accurate copy of the Servicer Welcome Letter is attached hereto as Exhibit A. As such, the Plaintiff holds a secondary lien on the Property and must be included as a party in this matter. The Plaintiff exhibited knowledge of the Proposed Intervenor’s lien position, as it provided the Proposed Intervenor notice of the delinquent Water Pollution Control Authority bill by letter dated March 28, 2024 (the “Notice of Delinquency”). However, the Proposed Intervenor was not made party to this action. B. LAW AND ARGUMENT The Proposed Intervenor is the holder of a lien subsequent in right to that of the Plaintiff and is thus entitled to intervene as a matter of right. In order for a proposed intervenor to establish that it is entitled to intervene as a matter of right, the proposed intervenor must satisfy a well-established four element conjunctive test: [T]he motion to intervene must be timely, the movant must have a direct and substantial interest in the subject matter of the litigation, the movant's interest must be impaired by disposition of the litigation without the movant's involvement and the movant's interest must not be represented adequately by any party to the litigation... A proposed intervenor must allege sufficient facts, through its motion to intervene and the pleadings, to make the requisite showing of its right to intervene. . . . Failure to meet any one of the four elements, however, will preclude intervention as of right." (Citations omitted; internal quotation marks omitted.) BNY Western Trust v. While the Proposed Intervenorrecognizes its lien is subsequent in right to that of the Plaintiff, this would not be grounds forexclusion.
